1. About these Terms

These Terms and Conditions govern your access to and use of BowlBrowser, including its pet profiles, product catalogue, filters, comparison tools, saved products, articles and third-party links.

By accessing or using BowlBrowser, you agree to these Terms and Conditions.

Please read them carefully. If you do not agree to these Terms, you must not use BowlBrowser.

BowlBrowser’s separate Privacy Policy and Cookie Policy also apply to your use of the website.

2. About BowlBrowser

BowlBrowser is a free online pet-food discovery and comparison service intended only for users in the United Kingdom.

In these Terms:

• “BowlBrowser”, “we”, “us” and “our” refer to BowlBrowser;
• “you” and “your” refer to anyone accessing or using BowlBrowser; and
• “retailer” or “provider” refers to a third-party business whose products or services are displayed or linked through BowlBrowser.

3. Who may use BowlBrowser

BowlBrowser may be used by people of any age.

BowlBrowser may also be used by individuals, businesses, breeders, shelters, veterinarians, pet shops and other organisations, provided it is used lawfully and in accordance with these Terms.

BowlBrowser is currently intended only for users in the United Kingdom. Product information, prices, retailers, delivery options and linked services may not be relevant or available outside the United Kingdom.

4. What BowlBrowser does

BowlBrowser helps users discover and compare dog food, cat food and related pet-care products and services.

BowlBrowser may allow you to:

• browse dog and cat food products;
• create profiles for pets;
• filter products using pet-profile information;
• filter and sort products using available catalogue information;
• compare product prices and prices per unit of weight;
• save or “heart” products;
• read general pet-food and nutrition content; and
• follow links to third-party retailers and providers.

BowlBrowser displays choice and comparison information only.

We do not manufacture, stock, own, sell, deliver or fulfil any pet food or other third-party product displayed through BowlBrowser.

We do not take payments, process orders, arrange deliveries, administer returns or provide refunds.

All purchases are completed directly on the relevant retailer’s website.

5. No account is required

BowlBrowser does not currently offer or require user accounts.

You do not need to register, sign in or provide an email address to browse products, create a pet profile, use filters or save products.

Pet profiles and saved products are stored locally in your browser or on your device, as explained below.

6. Pet profiles

You may create a pet profile to help filter the products displayed through BowlBrowser.

Depending on the pet and the information you choose to provide, a pet profile may include:

• species;
• age;
• dog size;
• preferred food types;
• food needs; and
• protein preferences.

Food-type preferences may include:

• dry;
• wet;
• raw;
• fresh or chilled;
• air-dried; and
• freeze-dried.

Food needs may include:

• grain-free;
• sensitive;
• hypoallergenic;
• limited ingredient; and
• single protein.

Protein preferences may include available options such as:

• chicken;
• beef;
• turkey;
• lamb;
• salmon;
• white fish;
• duck;
• venison;
• rabbit;
• pork;
• tuna;
• trout;
• cod;
• herring;
• mackerel;
• sardine;
• fish;
• game;
• goat;
• kangaroo; and
• working or sporting formulas.

Some profile fields are optional and may allow more than one selection.

You are responsible for ensuring that the information entered into a pet profile is accurate and kept up to date.

7. Product filtering

BowlBrowser uses the selected pet-profile details and other filters to narrow the available product catalogue.

Filtering results are comparison and discovery aids only.

A product appearing in a filtered result does not guarantee that it:

• is suitable for your pet;
• meets every dietary or nutritional requirement;
• is safe for a particular medical condition;
• is free from every ingredient your pet should avoid;
• has been personally recommended by BowlBrowser; or
• is the best product available for your pet.

Filtering depends on the profile information you enter and the product information available to BowlBrowser.

Incomplete, inaccurate or outdated profile or product information may affect the results.

You remain responsible for determining whether a product is appropriate for your pet.

8. Local browser and device storage

Pet profiles, saved products and product “hearts” are stored only in your browser or on your device.

BowlBrowser does not currently save this information in a central user-account database.

Locally stored information may remain available indefinitely unless:

• you delete the pet profile or saved information;
• you clear BowlBrowser’s site data;
• you clear your browser data;
• you reset or uninstall your browser;
• you change browsers or devices;
• you use private or incognito browsing;
• your browser removes the information;
• your device removes the information; or
• your device becomes unavailable, damaged or lost.

Information saved on one browser or device will not automatically be available on another browser or device.

Information created during private or incognito browsing may disappear when the private browsing session ends.

BowlBrowser requests persistent browser storage when a pet profile is saved. Persistent storage can reduce the risk that a browser automatically removes the information, but the browser or device makes the final decision.

We cannot guarantee that locally stored profiles or saved products will always remain available.

You are responsible for retaining any information that you consider important.

9. Product information

Product information displayed through BowlBrowser may include:

• product names;
• brands;
• descriptions;
• product images;
• ingredients;
• food types;
• feeding or life-stage information;
• package sizes;
• prices;
• prices per kilogram or another unit of weight;
• retailer information; and
• product availability information.

Product information is received through third-party commerce technology and merchant data sources, including UCP-enabled merchant connections where available.

BowlBrowser does not independently manufacture, label or test the products displayed.

Although we aim to provide useful and current information, product information may occasionally be:

• inaccurate;
• incomplete;
• delayed;
• incorrectly categorised;
• outdated;
• changed by a retailer or manufacturer;
• different from the current product packaging; or
• unavailable.

We may correct, update or remove product information when we reasonably believe it is inaccurate, incomplete, outdated or misleading.

10. Prices

BowlBrowser displays prices collected from available retailer and merchant data.

Prices are generally collected recently, including during the preceding night where applicable. However, prices may change after they are collected and before you visit the retailer’s website.

A price displayed on BowlBrowser is therefore a comparison aid and not a binding offer from BowlBrowser or the retailer.

The final price displayed by the retailer during checkout applies to your purchase.

A retailer’s final price may differ because of:

• a recent price change;
• a data delay;
• regional availability;
• delivery charges;
• minimum-order requirements;
• package-size changes;
• stock changes;
• a technical or data error; or
• other retailer conditions.

BowlBrowser does not add a markup to retailer prices.

11. Price-per-weight calculations

BowlBrowser may calculate and display a price per kilogram or another unit-price comparison.

These calculations are based on the product size and price information available to BowlBrowser.

A unit-price calculation may be inaccurate where:

• the displayed product weight is incorrect;
• the package contains multiple items;
• the product has a variable weight;
• the retailer changes the product size;
• the retailer changes the price;
• the source information is incomplete; or
• the product is incorrectly categorised.

You should check the current product size, price and unit-price information on the retailer’s website before purchasing.

12. Retailer checkout

When you select a retailer link, you leave BowlBrowser and visit a third-party website.

The retailer’s current product information, price, availability and checkout terms apply to the purchase.

Any contract for the purchase of a product is between you and the retailer.

BowlBrowser is not a party to that contract.

The retailer is solely responsible for:

• accepting or rejecting an order;
• taking payment;
• confirming the final price;
• supplying the product;
• stock availability;
• delivery;
• cancellations;
• returns;
• replacements;
• refunds;
• warranties;
• subscriptions offered by the retailer;
• customer service; and
• handling complaints about the purchase.

All order, payment, delivery, cancellation, return, replacement and refund enquiries must be directed to the retailer.

BowlBrowser cannot amend, cancel, refund or resolve a retailer order on your behalf.

13. Checking products before purchase and use

You must check the retailer’s current product page before completing a purchase.

Before feeding or using a product, you should also check its physical packaging and label, including:

• the product name;
• intended species;
• ingredients;
• allergens;
• nutritional information;
• age or life-stage suitability;
• package size;
• feeding instructions;
• preparation instructions;
• storage instructions;
• warnings; and
• expiry or best-before information.

Retailers and manufacturers may change recipes, ingredients, packaging or instructions without BowlBrowser being notified immediately.

Where BowlBrowser’s information differs from the retailer’s current product page, you should rely on the retailer’s current information when purchasing.

Where online information differs from the physical product packaging, you should follow the physical packaging and seek professional advice where appropriate.

14. Catalogue coverage

BowlBrowser does not guarantee that its catalogue includes every:

• UK pet-food product;
• retailer;
• brand;
• recipe;
• package size;
• product variation;
• available price; or
• provider.

Products and retailers may be added, changed or removed at any time.

A product not appearing on BowlBrowser may still be available elsewhere.

We do not guarantee that a product shown through BowlBrowser is the cheapest available option in the entire UK market.

15. Product ordering and affiliate commission

The order and filtering of products are based on:

• the filters selected by the user;
• the selected pet profile;
• available product data;
• the chosen sorting option; and
• technical catalogue considerations.

Product suggestions, filtering and ordering are not based on the amount of affiliate commission BowlBrowser may receive.

BowlBrowser does not add a markup to product prices.

16. Affiliate links

Some retailer and provider links on BowlBrowser may be affiliate links.

This means BowlBrowser may sometimes receive a commission or referral payment when a user follows a link and completes a qualifying purchase or other action.

BowlBrowser does not receive commission from every product, retailer or provider displayed.

The existence or amount of a commission does not determine:

• whether a product is included in filtering results;
• the product’s position in filtering results;
• whether a product is suggested;
• how a product is categorised; or
• whether BowlBrowser considers a product appropriate for a selected filter.

Affiliate arrangements help support the free operation of BowlBrowser.

Following an affiliate link will not normally increase the price you pay, although the retailer or provider always controls its own prices and terms.

Where relevant, affiliate or advertising content will be identified clearly on the relevant page, section and before a search where appropriate.

17. Pet insurance, preventative care and supplements

BowlBrowser may display information about or link to third-party providers of:

• pet insurance;
• flea, tick and worm treatments;
• preventative-care services;
• pet supplements; and
• other pet-care products or services.

These are click-through links only and may be affiliate links.

BowlBrowser does not collect or pass private information to these providers as part of the click-through process.

BowlBrowser does not:

• process applications;
• provide insurance cover;
• underwrite insurance;
• recommend a specific insurance policy as personally suitable;
• process claims;
• take payment;
• manage subscriptions;
• prescribe treatments;
• dispense veterinary products; or
• fulfil third-party products or services.

Any application, payment, policy, subscription, purchase or agreement is made directly between you and the relevant provider.

You must review the provider’s own:

• terms and conditions;
• privacy policy;
• eligibility requirements;
• product information;
• policy wording;
• exclusions;
• prices;
• renewal terms; and
• cancellation arrangements.

The provider is responsible for its own products, services, decisions and contractual obligations.

18. General information only

BowlBrowser may publish articles, brand information, nutrition guides and other educational content.

This content is provided for general information only.

It is not veterinary, medical, diagnostic, nutritional or other professional advice.

BowlBrowser does not diagnose medical conditions or prescribe diets, treatments, medicines or supplements.

You should consult a veterinarian or appropriately qualified pet nutrition professional before making significant dietary or health decisions, particularly where your pet:

• has an allergy or suspected allergy;
• has a medical condition;
• requires a therapeutic or prescription diet;
• takes medication;
• is pregnant or nursing;
• has unusual nutritional needs;
• has reacted adversely to a product; or
• is showing signs of illness or distress.

Do not delay seeking professional veterinary assistance because of information displayed on BowlBrowser.

In an emergency, contact a veterinarian or emergency veterinary service immediately.

19. Product suitability

You are responsible for deciding whether a product is suitable for your pet.

BowlBrowser does not guarantee that a product:

• is nutritionally complete;
• is suitable for a specific medical condition;
• will produce a particular health outcome;
• will be accepted by your pet;
• is free of cross-contamination;
• meets every dietary preference;
• contains no undeclared ingredient;
• is appropriate when combined with another product or medicine; or
• remains suitable after its formulation changes.

Terms such as “sensitive”, “hypoallergenic”, “grain-free”, “limited ingredient” and “single protein” may be used differently by different retailers or manufacturers.

You should review the manufacturer’s and retailer’s current information and seek professional advice where necessary.

20. Third-party websites

BowlBrowser contains links to websites operated by retailers, providers and other third parties.

We do not control those websites.

BowlBrowser is not responsible for:

• their availability;
• their security;
• their accuracy;
• their content;
• their privacy practices;
• their cookies or tracking technologies;
• their products;
• their services;
• their prices;
• their policies; or
• their actions or omissions.

A link does not necessarily mean that BowlBrowser endorses every aspect of the third party, its website, its products or its services.

You access third-party websites at your own discretion and subject to their own terms and policies.

21. Intellectual property

The BowlBrowser name, branding, website design, original illustrations, pet avatars, interface, software, original written content, catalogue organisation and other original materials are owned by or licensed to BowlBrowser.

These materials are protected by intellectual-property laws.

You may use BowlBrowser and view its content for lawful personal or business reference purposes.

Unless permitted by law or agreed by us in writing, you must not:

• copy substantial parts of BowlBrowser;
• republish BowlBrowser content;
• sell or license BowlBrowser content;
• reproduce BowlBrowser branding;
• create a competing catalogue using BowlBrowser data;
• remove ownership or copyright notices; or
• commercially exploit BowlBrowser’s original content or technology.

Product names, product photographs, descriptions, brand names, trade marks and logos belonging to retailers, manufacturers or other third parties remain the property of their respective owners.

They are displayed for product identification and comparison purposes.

Their appearance on BowlBrowser does not transfer ownership to BowlBrowser or necessarily mean that the owner endorses BowlBrowser.

22. Links to BowlBrowser

You may share or link to publicly available BowlBrowser pages, provided that you do so fairly and lawfully.

You must not:

• falsely suggest that BowlBrowser sponsors or endorses you;
• falsely suggest a partnership or commercial relationship;
• link to BowlBrowser from unlawful or misleading content;
• frame BowlBrowser within another website without permission;
• use BowlBrowser’s branding in a confusing manner; or
• damage BowlBrowser’s reputation.

We may ask you to remove a link that is unlawful, misleading or harmful.

23. Acceptable use

You must use BowlBrowser lawfully.

You must not:

• use BowlBrowser for fraud or unlawful activity;
• interfere with the operation or security of the website;
• introduce viruses, malware or harmful code;
• attempt to gain unauthorised access to BowlBrowser or its systems;
• probe or test the website’s security without permission;
• bypass technical restrictions or security measures;
• overload or disrupt the website;
• misuse retailer or affiliate links;
• impersonate another person or organisation;
• use BowlBrowser in a way that infringes another person’s rights; or
• encourage another person to do any of these things.

We may restrict access to BowlBrowser where we reasonably believe these Terms have been breached or the website, its users or third parties are at risk.

24. Automated access and scraping

Unless we have provided written permission, you must not use bots, crawlers, scripts or other automated tools to:

• scrape BowlBrowser;
• bulk-download catalogue information;
• systematically extract product information;
• reproduce the catalogue;
• monitor BowlBrowser in a way that places an unreasonable load on the website;
• bypass technical access controls; or
• create, train or improve a competing product, catalogue, database or service using BowlBrowser content.

Ordinary search-engine indexing that complies with our published technical instructions is not prohibited.

25. Availability

We aim to keep BowlBrowser available and functioning, but we do not guarantee:

• uninterrupted access;
• error-free operation;
• that every feature will always be available;
• that saved browser data will always remain available;
• that the catalogue will always be current;
• that every retailer connection will continue operating; or
• that the website will be free from every technical fault.

Access may be interrupted because of:

• maintenance;
• updates;
• security issues;
• hosting problems;
• third-party technology failures;
• retailer or merchant connection failures;
• internet or telecommunications problems; or
• circumstances outside our reasonable control.

26. Changes to BowlBrowser

We may add, change, suspend or discontinue:

• features;
• filters;
• pet-profile fields;
• product categories;
• retailers;
• providers;
• catalogue sources;
• website content; or
• parts of BowlBrowser.

We may make changes without prior notice where this is reasonably necessary for technical, security, commercial, legal or operational reasons.

27. Our responsibility to you

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

This includes liability for:

• death or personal injury caused by negligence;
• fraud or fraudulent misrepresentation; and
• any other liability that cannot legally be excluded or limited.

Nothing in these Terms affects any statutory rights that apply to you and cannot lawfully be excluded.

Subject to those protections, BowlBrowser is responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

We are not responsible for losses that were not reasonably foreseeable.

28. Matters outside BowlBrowser’s responsibility

To the fullest extent permitted by law, BowlBrowser is not responsible for losses or problems caused by:

• inaccurate, incomplete or outdated information supplied by a retailer, manufacturer, provider or commerce-technology source;
• a retailer or manufacturer changing a product, recipe, package, price or description;
• a product being unsuitable for a particular pet;
• your reliance on filtering results without checking the product information;
• inaccurate or outdated pet-profile details;
• your failure to check the retailer’s website or the physical product label;
• a retailer refusing, cancelling or failing to fulfil an order;
• stock being unavailable;
• delivery delays or failures;
• payment, refund or return disputes;
• a third-party product or service;
• a third-party website;
• locally stored profiles or saved products being deleted;
• use of private or incognito browsing;
• changing browser or device;
• browser or device storage decisions;
• internet, telecommunications or hosting failures;
• unauthorised access caused by circumstances outside our reasonable control;
• misuse of BowlBrowser; or
• events outside our reasonable control.

29. Business losses

Where you use BowlBrowser for business or commercial purposes, BowlBrowser is not responsible for:

• loss of profit;
• loss of revenue;
• loss of business;
• loss of contracts;
• loss of opportunity;
• loss of anticipated savings;
• loss of goodwill;
• loss of commercial data; or
• indirect or consequential business loss.

Nothing in this section excludes liability that cannot legally be excluded.

30. Privacy and browser storage

BowlBrowser’s Privacy Policy explains how information connected with the website is handled.

BowlBrowser’s Cookie Policy explains its use of browser storage and any cookies or similar technologies that may apply.

These policies should be read together with these Terms.

31. Complaints and suspected errors

Please provide enough information for us to understand and investigate the issue.

Complaints concerning an order, payment, product, delivery, refund, return, policy, subscription or third-party service must be directed to the relevant retailer or provider.

32. Changes to these Terms

We may update these Terms from time to time to reflect:

• changes to BowlBrowser;
• changes to our catalogue or technology;
• changes to our commercial arrangements;
• changes in law or regulation;
• new security requirements; or
• changes to how the website operates.

The latest version will be published on BowlBrowser with an updated “Last updated” date.

Updated Terms apply from the date they are published.

Your continued use of BowlBrowser after updated Terms are published means that the updated Terms apply to your subsequent use.

33. If part of these Terms is invalid

Each section of these Terms operates separately.

If a court or competent authority finds that any section is unlawful or unenforceable, the remaining sections will continue to apply.

34. No waiver

If BowlBrowser does not immediately enforce a provision of these Terms, this does not mean that we have waived the right to enforce it later.

35. Third-party rights

Unless expressly stated otherwise, these Terms do not give any third party the right to enforce them.

36. Governing law and courts

These Terms are governed by the laws of England and Wales.

If you are a consumer living in England or Wales, the courts of England and Wales will have jurisdiction over disputes relating to these Terms.

If you are a consumer living in Scotland, you may bring proceedings in Scotland or England and Wales.

If you are a consumer living in Northern Ireland, you may bring proceedings in Northern Ireland or England and Wales.

Nothing in this section removes any mandatory consumer rights or protections that apply to you.
